【對政府突然命令停止3月28日合法遊行的回應】
——Response to the Government's Sudden Order to Halt the Legal Protest on March 28
公眾原訂3月28日發起遊行表達對政府新一輪經濟計劃的不滿,日前雖已獲警方在多重防疫及治安限制下「開綠燈」,但在距離遊行起步不足24小時,卻突然遭受衛生局局長宣稱援引《傳染病防治法》叫停。
過去,警方聯同衛生局多次借防疫為由,阻撓市民依法行使本已岌岌可危的集會遊行自由,但與此同時,特定的大型群聚活動卻可如常進行,譬如大賽車、馬拉松賽事、慈善園遊會、美食節活動等。對於特區政府利用多重的防疫標準,提出連官方本身也無法保證的苛刻要求,在沒有充分理據的情況下,任意侵害受憲制保障的公民權利和自由,我們表示非常不滿。
還須指出的是,衛生局局長的命令及通知本身違反了《行政程序法典》及《傳染病防治法》的相關規定,存在多項可導致其非有效的瑕疵,包括:未有明確指出法律依據(《行政程序法典》第114及115條)、未有指明是否可就有關行為提出司法上訴(《行政程序法典》第70條)、欠缺理由說明(《行政程序法典》第114及115條、《傳染病防治法》第14條第2款)、不符合《傳染病防治法》第14條的適用前提、錯誤指出違反該命令的法律後果(《傳染病防治法》第30條)等等,嚴重偏離行政行為最基本應遵守的合法性原則,凸顯當局急於壓制公眾依法遊行自由的荒腔走板。
在此,我們呼籲各界正視政府的多重執法標準,並促請有關當局公平處理防疫工作,而非隨心所欲對不同民間活動厚此薄彼,甚至不惜踐踏憲制保障的集會遊行自由等基本權利。
A protest was scheduled to take place on March 28 for the public to express their dissatisfaction with the government's new round of economic scheme. Despite having been given the "green light" from PSP under multiple epidemic prevention and security restrictions, the protest was suddenly halted by the Director of the Health Bureau with reference to the "Law on Prevention and Control of Infectious Diseases" less than 24 hours prior to its commence.
In the past, PSP and the Health Bureau have repeatedly made use of epidemic prevention as an excuse to obstruct citizens from legally exercising their freedom of assembly and protest, which is already precarious. However, at the same time, certain large-scale activities can be carried out as usual, such as grand prix, marathon events, charity bazaar, food festival, etc. We are gravely dissatisfied with the SAR government's use of multiple standards of epidemic prevention to make demanding requirements that even the government itself cannot guarantee, to arbitrarily infringe the rights and freedoms of citizens constitutionally enshrined without sufficient justification.
It should also be noted that, the order and notification of the Director of the Health Bureau itself violates the relevant provisions of the "Administrative Procedure Code"(CPA) and the "Law on Prevention and Control of Infectious Diseases", and carries a number of flaws that can lead to its invalidity, including: it does not clearly indicate the legal basis (art. 114 and 115 of CPA), does not tell whether it is possible to lodge a judicial appeal (art. 70 of CPA), lack of explanation (art. 114 and 115 of CPA, and art. 14 no.2 of the “Law on Prevention and Control of Infectious Diseases”), does not comply with the applicable prerequisites of art. 14 no.2 of the “Law on Prevention and Control of Infectious Diseases”, mistakenly pointed out the legal consequences of violating the order (art. 30 of the “Law on Prevention and Control of Infectious Diseases”), etc., seriously deviating from the most basic principle of legality that all administrative acts should comply, which highlights the authorities’ eagerness to suppress the citizens’ legal exercise of freedom of protest.
Here, we call on everyone to take seriously the government’s multiple law enforcement standards, and urge the relevant authorities to handle epidemic prevention work fairly, instead of favoring one another non-governmental activities as they please, or even trampling on the citizens’ basic rights of freedom of assembly and protest guaranteed enshrined by constitutional legislations.
